COPYING RESTRICTIONS ON DOCUMENTS
WHENEVER the subject of what can and what can't be copied comes up , there is confusion The laws are confusingly ambiguous though the following is adapted from a legal opinion by the counsel for the National Newspaper Association :
The federal government states that photog raphic reproduction of any of the following items is forbidden under the penalty of fine or imprison ment : Obligations or securities of the United States Government , including Bonds ; Certificates of Indebtedness ; National Bank Currency ; Cou pons ; United States Notes ; Treasury Notes ; Gold Certificates ; Silver Certificates ; Fractional Notes ; Certificates of Deposit ; Bills , Checks or Drafts for money drawn by or upon authorized officers of the United States .
Also - Internal Revenue Stamps though , if it is necessary to copy a legal document in which there is a cancelled revenue stamp , this may be done provided the reproduction of the document is performed for lawful purposes ( See Sec . 402.2 of Internal Revenue Bulletin No. 7 ) .
The following are also restricted : Stamps and other representatives of value of whatever de nomination , which have been or may be issued under any Act of Congress ; Paper money in any form ; Licenses ( Driver's , Marine Officer's , Am ateur Radio Operators ' ) ; Automobile Registra tions ; Automobile Titles ( in certain states ) . Also Certificates of Citizenship and Naturalization ; Immigration Papers ; Passports ; Draft Cards ; Copy righted material ( without the permission of the copyright owner ) ; Obligations of any Foreign Government ; Bank or Corporation and Adjusted Compensation Certificates for World War Vets .
That is the listing of the most common sub jects which are illegal to photograph . However , the NNA counsel has held that photographs or printed illustrations of United States and foreign coins may be used for any purpose , not including advertising . " Printed Illustrations of paper money , checks , bonds and other obligations and securities of the United States and foreign governments are permissible for numismatic , educational , histor ical and newsworthy purposes , but not for gen eral advertising purposes . " So states Paul Conrad , NNA Legal Counsel in the Bureau of Advertising " Retail Memo .
The illustrations of paper money , checks or bonds must ( 1 ) be in black - and - white and ( 2 ) must be of a size less than three - fourths or more than 11 - times the size of the genuine instrument . No illustrations of paper money , checks or bonds may be in color , whether or not the color is the same as that of the genuine item .
To be permissible , an illustration must be ac companied by numismatic , educational , historical or newsworthy information relating directly to the item that is illustrated . Illustrations used prim arily for decorative or eye - catching purposes are not permissible .
Based on these facts it is apparent that the free lance photographer should be acutely cognizant of the complexity of the law when it comes to inclusion of documents or other government cer tificates , currency , cards , etc. , in his picture stories . When in doubt consult your attorney to obtain a decision as to the legality of the matter - just to be on the safe side .
